Voice service customers that are identified as violators of the Telephone Robocall Abuse Criminal Enforcement and Deterrence (TRACED) Act will potentially be subject to enforcement actions by the FCC, appropriate law enforcement, and termination of service.In addition, any customer that  Lightning Telecom identifies as originating robocalls will be contacted, their toll records investigated, and potentially have their service terminated if corrective measures are not taken to eliminate future issues.  The FCC’s Enforcement Bureau would also be contacted for appropriate action to be taken against the offending subscriber.

Payment and Billing
Users are responsible for payment of fees associated with the services. Billing details and payment terms are outlined on our website. Failure to pay may result in the suspension or termination of services. All rates, fees, and charges are exclusive of applicable Taxes, for which Customer is solely responsible. Taxes may vary based on jurisdiction and the Services provided. Taxes, access fees, universal service or other recovery fees, or similar charges will be adjusted on the date in which those increases become effective as mandated by competent authority. If any withholding tax is levied on the payments, then Customer must increase the sums paid to Lightning Telecom so that the amount received by Lightning Telecom after the withholding tax is deducted to  the full amount Lightning Telecom would have received if no withholding or deduction had been made.

   

Intellectual Property
All content and materials provided by Lighting Telecom, including but not limited to logos, trademarks, and software, are the property of Lighting Telecom and protected by intellectual property laws.

Disclaimer of Warranties
Lighting Telecom provides services “as is” without any warranty. We do not guarantee the accuracy, completeness, or reliability of our services.

Limitation of Liability
Lighting Telecom and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services.

Termination
Lighting Telecom reserves the right to terminate or suspend your account and access to services at our discretion, with or without cause.

Governing Law
These Terms of Service are governed by and construed in accordance with the laws of The Unted States of America.
